These Terms & Conditions ("Terms") govern your use of the website operated by Tipke Manufacturing Co., Inc. ("Tipke Manufacturing," "we," "our," or "us"), including the Tipke Manufacturing business pages and the FoldIt Cart product, accessory, replacement part, warranty, wholesale, and support pages. By accessing or using the website, you agree to these Terms. If you do not agree, do not use the website.

 

2. Separate Website Environments

The Tipke Manufacturing pages and FoldIt Cart pages may be hosted within the same website, but they serve different purposes. The Tipke Manufacturing pages provide information about manufacturing services and project inquiries. The FoldIt Cart pages provide information about the FoldIt Cart product, accessories, replacement parts, support, warranty, wholesale, and related product inquiries. Cross-links between the two areas are provided for convenience and do not change the separate purpose of each area.

 

3. Website Information Only

Website content is provided for general informational purposes only. We work to keep information accurate, but content may contain errors, omissions, outdated information, typographical errors, or changes in availability, equipment, specifications, pricing, product details, accessories, parts, services, or timelines. We may update, remove, or change website content at any time without notice.

 

4. Quotes, Orders, and Business Agreements

Submitting a contact form, quote request, project description, FoldIt Cart inquiry, accessory request, replacement part request, wholesale inquiry, warranty request, or support question does not create a contract, purchase order, manufacturing obligation, product order, warranty approval, or service commitment. Quotes, pricing, timelines, purchase orders, accepted specifications, manufacturing commitments, warranty decisions, wholesale terms, shipping terms, and other business terms are not binding unless confirmed by Tipke Manufacturing in writing.

If a separate written quote, invoice, purchase order acknowledgment, manufacturing agreement, nondisclosure agreement, wholesale agreement, distributor agreement, warranty document, or other signed agreement applies, that written document will control to the extent it conflicts with these Terms.

 

5. Manufacturing Project Submissions

You may submit drawings, files, photos, specifications, measurements, samples, quantities, materials, tolerances, timelines, or other project details for review. By submitting those materials, you represent that you have the right to provide them and that our review of them will not violate any third-party rights, confidentiality obligations, export laws, sanctions rules, intellectual property rights, or other restrictions.

Unless Tipke Manufacturing has signed a separate nondisclosure agreement or other written agreement, website submissions are not confidential and do not create a fiduciary, confidential, exclusive, or nondisclosure relationship. Do not submit proprietary, sensitive, regulated, export-controlled, ITAR-controlled, classified, trade-secret, or confidential information unless appropriate written protections are in place.

You retain ownership of the materials you submit. You grant Tipke Manufacturing a limited right to use, copy, review, store, and share the submitted materials internally and with service providers, advisors, insurers, or manufacturing partners as reasonably necessary to evaluate your request, communicate with you, prepare a possible quote, assess manufacturability, or manage related business records.

 

6. Customer Responsibility for Specifications and End Use

You are responsible for the accuracy, completeness, legality, and suitability of the specifications, drawings, tolerances, materials, intended use, safety requirements, regulatory requirements, testing requirements, and performance requirements you provide. Tipke Manufacturing may provide practical manufacturing feedback, but website communications and preliminary review do not replace engineering review, legal review, safety analysis, regulatory review, product testing, certification, or other professional evaluation required for your application.

 

7. Restricted, Regulated, and Export-Controlled Projects

Do not submit project information involving weapons, ammunition, military or defense articles, aerospace/defense technical data, controlled technologies, hazardous materials, medical devices, regulated products, export-controlled items, sanctioned parties, or prohibited end uses unless you first disclose the nature of the project and appropriate written controls are in place. Tipke Manufacturing may decline any project or request at its discretion.

 

8. FoldIt Cart Product Information

FoldIt Cart product information, specifications, accessories, replacement parts, diagrams, manuals, dimensions, load ratings, warranty information, and availability are provided for general product and support purposes. Product details may change, and customers should confirm current information before purchase, use, repair, replacement, or reliance on a specific specification.

If you purchase a FoldIt Cart or related item through a third-party retailer, distributor, or marketplace, that third party's purchase terms, payment terms, shipping terms, return policy, customer service process, and privacy policy may also apply. Tipke Manufacturing is not responsible for third-party retailer or marketplace content, transactions, delays, policies, pricing, product descriptions, product availability, shipping estimates, or representations.

 

9. FoldIt Cart Safety and Use

Before assembling or using a FoldIt Cart, read and follow the owner's manual, warnings, instructions, and safety information provided with the cart. Failure to follow instructions, warnings, safety rules, and basic precautions may result in serious injury or death.

Important safety requirements include, without limitation:

• Do not use the cart to transport people or animals.

• Do not allow children to operate or play with the cart.

• Do not make unauthorized modifications to the cart or use the cart in a way that may impair safety or function.

• Use care when folding and unfolding the cart; work gloves may help reduce hand or finger injuries.

• Regularly inspect the cart for damage or wear that may affect integrity.

• Do not stand or sit on the cart or use it as a work surface.

• Do not exceed the stated 330 lb. load capacity.

• Use the cart on flat, level surfaces capable of supporting the maximum load capacity.

• Distribute loads evenly and follow loading instructions.

• The cart is designed to be pushed, not pulled.

• Inflate pneumatic tires only as instructed. Do not over-inflate. The owner's manual states a recommended maximum of 35 PSI and a lower maximum of 30 PSI in extreme heat above 100 degrees Fahrenheit.

The warnings and instructions provided with the cart cannot cover every possible condition or situation. Use common sense, inspect the product before use, and stop using the cart if it appears damaged, unsafe, or unsuitable for the intended use.

 

10. FoldIt Cart Accessories and Replacement Parts

Accessory and replacement part listings are provided to help customers identify possible parts or support needs. Availability, compatibility, pricing, shipping, and installation requirements must be confirmed before order fulfillment. Use only compatible parts and accessories. Improper installation, incompatible parts, unauthorized modifications, or misuse may affect safety, product performance, and warranty coverage.

 

11. FoldIt Cart Limited Warranty

The owner's manual states that Tipke Manufacturing Co., Inc. warrants the FoldIt Cart to be free from material or workmanship defects for a period of two years from the date of purchase. Under that warranty, Tipke Manufacturing will replace without charge any original part that Tipke Manufacturing determines to be defective. Transportation and labor charges are not covered. Failure due to accident, abuse, or normal wear is not covered. Warranty rights may vary by state or jurisdiction.

Warranty review may require proof of purchase, product identification, photos, part identification, a description of the issue, or other information reasonably necessary to evaluate the request. A website inquiry does not guarantee warranty approval. Nothing in these Terms is intended to limit warranty or consumer rights that cannot be limited under applicable law.

 

12. Shipping, Returns, and Third-Party Retailers

If Tipke Manufacturing accepts a direct order through the website or by direct communication, shipping, payment, taxes, availability, delivery timing, cancellations, and returns will be governed by the written terms provided for that transaction. If a product is purchased through a third-party retailer, distributor, or marketplace, that seller's purchase, shipping, return, refund, exchange, and customer-service terms may apply.

 

13. Made in USA, Origin, and Product Claims

Any country-of-origin, domestic-content, environmental, performance, capacity, durability, or product-comparison claim must be understood in the context of the specific claim made on the applicable product page, packaging, manual, label, quote, or transaction document. Tipke Manufacturing may update or qualify such claims as needed to reflect current sourcing, manufacturing, or legal requirements.

 

14. Intellectual Property and Website Content

All website content, including text, photographs, product images, graphics, videos, diagrams, downloads, manuals, forms, layouts, logos, service descriptions, product descriptions, and other materials, is owned by Tipke Manufacturing, licensed to Tipke Manufacturing, or used with permission unless otherwise stated.

You may view website content for personal or internal business evaluation purposes. You may not copy, download, reproduce, scrape, modify, publish, distribute, sell, display, train artificial intelligence systems on, or otherwise use website content, photos, graphics, product images, diagrams, manuals, or service descriptions for any commercial purpose without Tipke Manufacturing's prior written permission.

 

15. Prohibited Website Uses
